Part 1: General Terms and Conditions | |||
1.1 Agreement of Terms and Conditions | |||
1.1.1 | These Terms and Conditions apply to any kind of relations and conditions between users and the company. | ||
1.1.2 |
All relevant terms (including but not limited to policies, conditions, agreements etc.) designated by the company for our services, are considered as a part of these Terms and Conditions. | ||
1.1.3 |
Users are required to understand clearly and give consent to these Terms and Conditions in order to use our services. By using the service, you consent to our Terms and Conditions. | ||
1.2 Name of the service | |||
1.2.1 | The service provided by the company is named as “JPN Hub”. | ||
Part 2: Member | |||
2.1 Membership | |||
2.1.1 |
All unregistered users are required to understand and give consent to the Terms and Conditions, and register as a member through designated procedures in order to use the services. | ||
2.1.2 | Any user who gives no consent to the Terms and Conditions are not able to be registered as a member nor to use the service. | ||
2.1.3 |
All unregistered users are required to register in person. If any underage unregistered user who intended to be registered as a member, should be entitled to do so by parents or guardians. | ||
2.1.4 |
Registering as other parties, or using other parties’ information when processing register procedures are prohibited. Moreover, lending, transferring, or selling, etc., membership to third parties is prohibited. | ||
2.1.5 |
According to the “Act on Prevention of Transfer of Criminal Proceeds” of Japan, all registered users are required to complete the Identity confirmation process. Any users who failed to provide any identity documents in order to complete the Identity confirmation process, are not allowed to use the services. | ||
2.2 Member registration | |||
2.2.1 |
Users of the service must be entitled by the company as a member, by giving consent to the Terms and Conditions and completing the member registration procedures. | ||
2.2.2 |
Users of the service are required to register as member, by providing correct personal information as required (including but not limited to name, date of birth, address, phone number, email address, etc.), through designated member registration procedures. | ||
2.2.3 |
The company may refuse to allow any unregistered user to be registered as a member of the service due to any reasons listed below. Moreover, any inquiries referring to reasons of refuse would not be answered. | ||
(a) Registering with false, incorrect, missing information | |||
(b) Any person who violated the Terms and Conditions | |||
(c) Taking any action to interfere the operation of this service, or intend to do so | |||
(d) Any unregistered person who default on debt to the company, or have outstanding accounts | |||
(e) Any unregistered person who is underage, and not entitled to be registered by parents or guardians. | |||
(f) Any other circumstances decided by the company | |||
2.2.4 |
The company may refuse registration or terminate membership of any unregistered person who intends to be registered or member of the service, if the company decides it is not or no longer appropriate to do so. | ||
2.3 Username and password | |||
2.3.1 | User has all responsibilities for keeping their username and password after being registered as a member of the service. | ||
2.3.2 |
Transferring, lending, selling, sharing, etc., of username and password to third parties is prohibited. Users are considered as using the service in person under all circumstances. | ||
2.3.3 | User is liable to compensation for any damages to the company which caused by unauthorized usage of username and password. | ||
2.3.4 |
User should contact the company as soon as possible if any suspicious access was found, and carry out any action instructed by the company. In addition, user is liable to compensation for any damages to the user which is caused by unauthorized usage of username and password. | ||
2.3.5 |
Users should change the login password from time to time. The company is not liable for any damages caused by negligence of the aforesaid duty. | ||
2.4 Notification of modification | |||
2.4.1 | User should contact the company as soon as possible if any personal information submitted should be modified. | ||
2.5 Quitting | |||
2.5.1 |
Users may quit the membership at once. However, quitting is not allowed if there is any outstanding account unless the account is settled. | ||
2.5.2 | Membership of users who are certified dead will be automatically terminated. | ||
2.6 Termination and delete of membership | |||
2.6.1 |
The company may temporarily suspend or terminate any user’s membership, without notifying the certain user in advance, under any circumstances listed as below. | ||
(a) Unauthorized usage of username and password | |||
(b) Unauthorized usage of the system by the user or third party | |||
(c) Registering with false, incorrect, missing information | |||
(d) Default on debt to the company, or have outstanding accounts and refuse to settle | |||
(e) User has proceedings filed against him, including seizure, provisional seizure, provisional injunction, compulsory execution, bankruptcy or civil rehabilitation, or files for such proceedings himself | |||
(f) Violation of the Terms and Conditions | |||
(g) Any other circumstances decided by the company | |||
Part 3: Service | |||
3.1 Content of the service | |||
3.1.1 | This service provided by the company includes collecting, storing, re-packing, and shipping goods on behalf of the user. | ||
3.1.2 |
Any shipping address provided by the company (“depot address”) is not allowed to be used as resident registration and in any official registration. | ||
3.1.3 |
Unauthorized usage (including but not limited to registering for dating website, multilevel marketing, adult site, information marketing, etc.) of the depot address is prohibited. | ||
3.1.4 | Registering the depot address for any leaflet, advertisement mail, direct mail, etc., unless permitted by the company, is prohibited. | ||
3.2 Change, suspension, terminate of the service | |||
3.2.1 |
The company may change, add, temporarily suspend, stop, terminate, delete any part of the service without notifying users in advance. The company is not liable for any damage caused by aforesaid actions. | ||
3.2.2 |
The company may temporarily modify, suspend, stop, terminate any part of the service without notifying users in advance under circumstances listed as below. | ||
(a) Check and maintenance of the system in order to operate normally | |||
(b) In circumstances of force majeure, for example fire, power outage, natural disaster, etc., which the service could not be provided normally | |||
(c) Any other circumstances which leads to a halt or suspension of the service | |||
3.2.3 |
In circumstances of data damage or missing which caused by outer reason, the company would do its best to recover, but not liable to any damage caused. | ||
3.3 Prohibited actions | |||
3.3.1 | Users are prohibited to proceed any action listed as below while using the service | ||
(a) Violation of rights of the company or third parties (including but not limited to copyright, portrait rights, publicity rights, etc.) | |||
(b) Criminal activates | |||
(c) Violation of laws, orders, Terms and Conditions, or public order and morals | |||
(d) Taking any action to interfere the operation of this service or the company | |||
(e) Unauthorized access of instruments or service provided by the company | |||
(f) Faking as third party, or using fake information on the service | |||
(g) Unauthorized usage of information or goods provided by the company | |||
(h) Any other circumstances decided by the company | |||
3.3.2 | User is liable to compensation for any damages caused by violating the Terms and Conditions | ||
3.4 Refuse of providing service | |||
3.4.1 |
The company has the right to refuse to provide the service, no matter consent is given before or not, to any user under the following circumstances. | ||
(a) Goods delivered, or intend to be delivered, contains restricted content | |||
(b) User’s address or sender’s address could not be confirmed | |||
(c) User have outstanding account | |||
(d) User refuse to collect the parcel | |||
(e) Postage not paid goods | |||
(f) Goods refused by delivery agents | |||
(g) Goods detained by the customs | |||
(h) Violation of Terms and Conditions | |||
(i) Any other circumstances decided by the company | |||
3.5 Payment of the service | |||
3.5.1 |
The charges of the service have been displayed as the table of charges on this website. The company reserves the right to modify the table of charges without notifying or having consent from users in advance. | ||
3.5.2 |
The charges are based on the size and weight of the packed goods. The company would not refund any outstanding amount if the size and weight estimated by the company is differ from the final measurement by the delivery agents. | ||
3.5.3 | User is required to pay all charges through designated payment method within the designated period. | ||
3.5.4 |
The company is not liable for any fee other than delivery cost charged by delivery agents, for example custom duties and etc. Users are liable to pay all aforesaid additional fees. | ||
3.6 Cancellation of order | |||
3.6.1 | Any order which has been paid could not be cancelled. | ||
3.7 Refund | |||
3.7.1 | Any parcel which has been sent could not be refunded. | ||
Part 4: Goods | |||
4.1 Notification of goods information | |||
4.1.1 |
User is required to notify the company with correct information of goods which intended to be collected by the service, through designated method and within designated period of time. | ||
4.1.2 |
User is responsible for any irregular situation (such as missing, wrong collection, etc.) caused by inaccurate information provided by himself. | ||
4.1.3 |
The company would not verify any official documents, such as export invoice, permission deed, etc., provided by the user if it’s necessary to submit. Users are liable to any penalties or disadvantages caused by proving false or incorrect submission. | ||
4.1.4 |
The company reserves the right to handle (including but not limited to opening, checking, refusing to collect, transferring, etc.) goods delivered to depot, which without prior notification from the user within designated period of time, freely, without notifying or having consent from the certain user. | ||
4.2 Storage | |||
4.2.1 |
User is required to deliver any item towards designated address by designated method in order to use the service. Users are liable for all costs and responsibilities relevant to the delivery. | ||
4.2.2 |
The company would carry out checking and storing procedures after goods were delivered to the designated address. Notification would be sent to user after the aforesaid procedure is completed. | ||
4.2.3 |
The company is not liable for degradation over time or decline in quality of goods which stored inside the depot. However, exceptions would be allowed if the user could provide any evidence which the company is liable for missing or damages of a certain good. | ||
4.2.4 |
Storage fee within the certain period of time designated by the company would be waived. Users are liable for paying designated storage fee, which is calculated per day and per goods after the aforementioned free period, before shipping out the certain goods. | ||
4.2.5 | Users would lose all rights of the goods delivered to the depot, which is 1 months after the aforementioned free period due. | ||
4.3 Checking | |||
4.3.1 |
The company reserves the right to open and check goods delivered to the depot. However, the company is not liable to conduct quality inspection for goods delivered nor verifying whether the quality or legal status of the goods. | ||
4.3.2 |
The company reserves the right to suspend storing procedure and content governing agencies for further inspection if illegal or suspicious items were found. | ||
4.3.3 |
The company might refer to invoice or receipts packed with the goods delivered to understand contents of the package, but not liable for any misunderstanding caused by false, fake, misleading of invoice or receipts. | ||
4.3.4 |
The company would do its best to avoid, but not liable for, damages or disadvantages towards users caused by checking procedure and other designated procedure. | ||
4.3.5 |
User gives consent to the company to open, check, conduct further actions to goods delivered to the depot on behalf of user, in order to use the service. The company is not required to notify user in advance before executing the aforesaid rights. | ||
4.4 Shipping | |||
4.4.1 | The company is not a delivery agent. User gives consent to the company to conclude contracts with delivery agent on behalf of the user. | ||
4.4.2 |
User should contact the company as soon as possible if any delivery accident (including but not limited to incomplete delivery, delay, damages, etc.) occurred. Although the company would contact delivery agent for investigation and try any possible ways to cooperate with it, the final compensation confirmed by delivery agent shall prevail since the company is not a delivery agent. | ||
4.4.3 | The company is not liable for any responsibilities on the parcel, such as damages, violation of copyright, and etc. | ||
4.4.4 |
User is liable for damages or disadvantages (including but not limited to incomplete delivery, return, transfer, disposal, etc.) occurred by false or misleading information (including but not limited to goods information, address, telephone number, etc.) provided by the user. | ||
4.5 Restricted items and further actions | |||
4.5.1 | The items listed as below are restricted, and prohibited from using the service. | ||
(a) Dangerous goods such as explosives, guns, swords, weapons, weapons, flammable liquids, high pressure gas, flammable substances, oxidizing substances, poisons, corrosive substances, radioactive substances, pathogens, etc. | |||
(b) Narcotics, psychotropic drugs, and other illegal drugs | |||
(c) Live animals and plants, dead or taxidermy animals | |||
(d) Human body, or part of the human body, corpse, ashes, etc. | |||
(e) Financial goods such as coins, banknotes, paper money, securities of any kind payable to the bearer, traveler’s checks, etc. | |||
(f) Processed or unprocessed platinum, gold or silver, precious stones and other valuables | |||
(g) Financial cards such as credit card, cash card, etc. | |||
(h) Letter | |||
(i) Food, other alteration, or perishable things | |||
(j) Counterfeit or pirated articles, obscene or immoral articles | |||
(k) Goods prohibited from import or dissemination at destination or transferring nations | |||
(l) Articles prohibited to be mailed by Postal Law | |||
(m) Articles prohibited to be mailed internationally designated by the delivery agent | |||
(n) Any other not mail-able goods decided by the company | |||
4.5.2 |
The company reserves the right to dispose any restricted items delivered to the depot, and not liable for any damages or disadvantages caused to the user. | ||
4.5.3 |
The company reserves the right to retain any revenue occurred by selling restricted items under the right designated by afore provisions, and consider those revenue (if any) as the charges for storing and disposal. If any damages or fees incurred when selling the restricted item, user is liable to compensate the corresponding amount to the company. | ||
4.5.4 | Notwithstanding the provisions of this section, the company may take procedures under the Civil Enforcement Law. | ||
Part 5: Disclaimer | |||
5.1 |
The company does not promise any information provided by, or through, the service is accurate or certain. Moreover, the company is not liable for any responsibilities for advertisements or information displayed by third parties on the service. | ||
5.2 |
The company is not liable for any data loss, communication delay, or disadvantages to users caused by electronic mechanical false (including but not limited to internet communication, internet service, computer machine, etc.) | ||
5.3 | The company is not liable for any damages or disadvantages to user caused by user breaching the Terms and Conditions. | ||
5.4 |
The company is not liable for service down caused by force majeure (including but not limited to fire, power outage, natural disaster, etc.) | ||
5.5 |
The company is not liable for any disadvantages, debts, damages to the user or third parties caused by suspending or terminating membership of a certain user empowered by the Terms and Conditions. | ||
5.6 |
The company is not liable for any damages or loss to users or third parties due to reasons which are not responsible by the company, no matter foreseen or not, except those situations designed by the Terms and Conditions. | ||
5.7 |
Any message or notification which sent by the company towards contact addresses registered by the user are considered completely delivered. | ||
5.8 | The company is not liable for any disputes occurring between inter-user, or user-third parties, whether it is relevant to the service or not. | ||
Part 6: Handling personal data | |||
6.1 | The company would collect and use users’ personal data for the following designated usage. | ||
(a) Management of member data, order data | |||
(b) Packing and shipping parcels | |||
(c) Requesting for bills and any kind of charges | |||
(d) Sending notifications, after-services, advertisements, campaigns of the service | |||
(e) Sending advertisements, promotions, sales notification of the company, relevant or alliance companies, or third-parties’ goods | |||
(f) Sending email magazine | |||
(g) Giving out points and coupons | |||
(h) Sending questionnaires, conducting census and data analysis | |||
(i) Conducting marketing investigations, analysis, research & design of new products | |||
(j) Any kinds of contacts, and handling inquiries | |||
(k) Displaying posts posted by members | |||
(l) Recruitment | |||
(m) Creating analysis report for the company, relevant or alliance companies | |||
(n) To complete duties relevant to personal data entrusted to relevant or alliance companies | |||
(o) Considering for business alliance | |||
(p) To incur the liabilities and perform the obligation under business contracts and laws | |||
(q) Any other business related to the afore provisions | |||
6.2 |
The company may utilize user’s personal data (including but not limited to name, sex, email address, telephone number, address, date of birth, payment information, order history, points, etc.) corporately with relevant or alliance companies for the aforesaid usages. | ||
6.3 |
The company reserves the right to open and check goods of users delivered to the depot under the right empowered by the Terms and Conditions. | ||
6.4 |
The company would use cookie or similar tracking technologies in order to track actions of the service and to store designated data. Users may disable cookies through internet browser settings, but some services might be restricted by the effects of disable cookies. | ||
6.5 | User is considered as giving consent to all provisions of the Terms and Services, which are relevant to handling personal data. | ||
Part 7: Updates on the Terms and Conditions | |||
7.1 |
The company may update (including but not limited to adding, terminating, suspending, deleting, etc.) any or all parts of the Terms and Conditions at anytime without notifying or having consent of user in advance. Once the Terms and Conditions was updated, it applies to the service immediately. | ||
Part 8: Annexes | |||
8.1 Sections and headings | |||
8.1.1 | Section and headings are only for convenience, and shall not nullity any provisions of the Terms and Conditions. | ||
8.2 Legal status of provisions | |||
8.2.1 | Any provisions which are nullified by the judgment of courts shall not affect the legal status of remaining provisions. | ||
8.2.2 | Any provisions which are nullified by laws of a jurisdiction shall not affect the legal status of remaining provisions. | ||
8.3 Applicable Law | |||
8.3.1 | The Terms and Conditions shall be governed by the laws of Japan. | ||
8.4 Court of Jurisdiction | |||
8.4.1 |
District Court which exercises jurisdiction over the location of the head office of the company shall have exclusive jurisdiction over any disputes which occurred and are relevant to the Terms and Conditions. | ||
8.5 Languages | |||
8.5.1 |
The Terms and Conditions is written in Japanese, English, and Chinese. In event of any conflict between three language versions, the Japanese version shall prevail. | ||
8.6 Effective | |||
8.6.1 | The Terms and Conditions is effective from 1st June, 2021, and applies to all users of the service. | ||
